A five-year old boy lived near an automobile sales lot. The afternoon of September 4, 1936, defendant drove his car upon the lot, stopped near the building thereon and spent something like an hour tinkering with the car and also went into the building. While he was so engaged the boy came on the lot, sat down near the side of the building and the rear of the car, and was playing in the dirt.
