AMENDED MEMORANDUM OF OPINION AND ORDER
LEVI, District Judge.
This is an action under the citizen suit provision of the Clean Water Act (“CWA”), 33 U.S.C. § 1251 et seq. The subject of the suit is a wastewater treatment plant operated by defendant, the City of West Sacramento, under a permit issued by the State Regional Water Quality Control Board for the Central Valley Region (the “Board”). 1 Plaintiff California Sportfishing Protection Alliance (“CSPA”), alleges that since June 1989 the plant has been operated in violation of its permit and that the violations are continuing.
