The circuit court of Ford county set aside an order of the Illinois Commerce Commission requiring the New York, Chicago and St. Louis Railroad Company, appellee, to maintain at its own expense a side-track alongside the elevator and coal yard of Lawson Tjardes, appellant. The cause is here on appeal.
Appellant’s elevator and other buildings used in connection with his business are located on land belonging to the railroad company and south of and adjacent to a switch-track at a small station called Derby. At the time the switch-track was built it connected at both ends with the main-track.…
