Defendant-appellant (Poling) was convicted after a trial by court of driving a vehicle while under the influence of liquor and public intoxication. He was fined $100.00 and his license was suspended for one year on the first charge and he was fined $25.00 on the other.

Poling appeals the conviction of driving while under the influence of liquor, alleging, inter alia, insufficiency of the evidence and error in the action of the trial court in not staying the suspension of his driver’s license, pending appeal.
