Rehearings were granted in these cases to the end that further consideration might be given them because, principally, the court was divided on the paramount question of fact involved, and to reach the conclusion arrived at by the majority, the lower court’s "finding on questions of fact had to be reversed. The record has again been closely studied, resulting in a confirmation of the conclusions heretofore adopted, and which form the bases of our judgments.
