Appeal by the defendant, The Tribune Association, from an interlocutory judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 26th day of March, 1902, upon the decision of the court’ rendered after a trial at the New York Special Term overruling a demurrer to the' complaint.

Action to recover .damages for an alleged libel. The complaint' charges that on the 29th of May, 1901, the defendant maliciously published in its newspaper of and concerning the plaintiff the following article:

“ The officials of the Mutual Life Insurance Company in this city were surprised at the news tif the suicide of Alvah W. Brown," one of the agents of the company, on the Fall River boat Plymouth yesterday at Newport. Charles H.
