Plaintiff Gary L. McCoy brought a personal injury action against his uncle, defendant Roland D. McCoy, for injuries he sustained while on a hayride. Plaintiff Carol J. McCoy brought an action for loss of consortium due to the injuries her husband sustained on this hayride. Defendant filed a motion for summary judgment, which was granted by the trial court on August 23, 1991. Plaintiffs appeal, contending the evidence of defendant’s illegal operation of the tractor from which Gary fell was sufficient to make the granting of summary judgment in favor of defendant improper.
