1Per curiam

The appellant was convicted in the lower court of burglary in the first degree and his punishment was fixed at life imprisonment in the State penitentiary. The indictment charging the offense ttpon which this case is based was returned by the Grand Jury of Shelby County on October 30, 1968. There were several other indictments returned against the appellant based upon incidents which happened on the night of September 3, 1968.

Before the trial took place in the case at bar it appears that the appellant had been tried on at least one or more indictments and had spent a short time in Bryce…
