This action -presents the question whether the defendant is liable for injuries caused to the plaintiff herein by reason of being bitten by a horse owned by the defendant.

The facts testified to are as follows: The plaintiff was walking on the thoroughfare known as Thirteenth street, eastward of Broadway, in the city of New York. She was walking on that portion of the highway reserved to pedestrians. The thoroughfares in the city of New York are so laid out as to divide the streets in a manner which reserves to pedestrians one part of the thoroughfare, and another part for vehicular use. The…
