The Cosmopolitan State Bank sued the Lake Shore Trust and Savings Bank in the municipal court of Chicago to recover the amount of a check for $1762.50, dated November 5, 1925, drawn by A. Anderson on the plaintiff, payable to the order of the Auburn Automobile Company, appearing to be indorsed by the payee, which was cashed by the defendant, indorsed by it and presented to and paid by the plaintiff.
