Johnson, plaintiff in error, to whom we shall hereafter refer as defendant, on March 30, 1907, entered the banking house of the defendant in error, to whom we shall refer as plaintiff, where and when he paid a certain sum of money to one of plaintiff’s tellers, and received therefor a certificate of deposit in the sum of $315. The controversy out of which this action grows arises over the contention as to the amount of money actually paid to the teller by defendant.
