The declaration of the plaintiff, administra-trix of the estate of Mary K. Howard, in this action of tort is in two counts. The first alleges that the defendant negligently caused her death. The second seeks recovery for conscious suffering. The defendant filed a general denial and alleged contributory negligence. The plaintiff excepted to the trial judge’s direction of a verdict for the defendant on each count and to the exclusion of certain evidence offered by her.
