The defendant appeals from his convictions of armed robbery and murder in the first degree. The defendant alleges error in (1) the denial of his motion for a required finding of not guilty as to the indictment charging murder; (2) the denial of his motion to dismiss on the ground of double jeopardy prior to the commencement of his second trial; (3) the prosecutor’s closing argument; and (4) the judge’s instructions to the jury.
