This action relates to the infringement of letters patent No. 37,649, dated November 7, 1905, and granted to Daniel I. Tompkins, complainant’s assignor, for a design for a bed-*670spring. A drawing of the design attached to the patent fairly indicat.es the intention of the patentee to impart to the bedspring an original and attractive appearance and a somewhat different character from prior designs and thereby to enhance its salability.
