We grant appellant, Paul Herbert’s, motion for rehearing, withdraw our opinion of August 3,1995, and substitute this opinion in its stead.

Paul Herbert appeals a default judgment in favor of appellee Greater Gulf Coast Enterprises, Inc., D/B/A Gulf Coast Enterprises, Inc. (Gulf Coast), in a suit brought under Tex.Peop.Code Ann. § 162.001 (Vernon 1984).
