On September 15, 1989, a jury found Timothy Scott Maland guilty of rape, second degree kidnapping, and infamous crime against nature. See I.C. §§ 18-6101 (rape), 18-4501, -4508 (kidnapping), 18-6605 (infamous crime against nature). The district court entered judgments of conviction, imposed sentences and denied several of Ma-land’s motions. The court later determined Maland’s sentences to be illegal. Maland was resentenced. The court then suspended the new sentences, and placed Maland on probation. He subsequently violated probation, prompting the court to rescind the…
