{¶ 1} Defendant-appellant, Kevin Keith, appeals the judgment of the Court of Common Pleas of Crawford County denying his motion for leave to file a delayed motion for a new trial, as well as the underlying motion for a new trial. On appeal, Keith argues that the trial court erred when it abused its discretion in denying his motion without holding a hearing, when it evaluated and denied his motion under the wrong standards for a new trial, when it applied the doctrine of res judicata to his claims, and when it failed to rule on his claims under Arizona v.
