The question here arises under an order to show cause why the court should not make an order striking this case from the Special Term calendar of the Supreme Court, Suffolk county, and placing it upon the Trial Term calendar of said court for a trial by jury. *810The motion is to be considered upon the summons and the amended complaint and the answer, which was interposed the day prior to the argument.
