Affirming.

Tbe appellee operates a street railway line on Sixth street in tbe city of Dayton, Ky., connecting tbat city with tbe city of Cincinnati. Appellee’s intestate, Alex Twaddell, lived in Dayton and bad for many yearsi travel-led this line daily, going to and from bis work in Cincinnati. He was 59 years of age but with the aid of glasses bad good vision and was in possession of .all his faculties.
