OPINION

BRUGGINK, Judge.

This case arises out of an agreement between an education provider, plaintiff, San Juan City College (“SJCC”), and the Department of Education (“DOE”) with respect to federal student financial aid payments. The agreement is unusual in that it is completely a creature of statutes and regulations-virtually all of the parties’ respective rights and obligations are dictated by law. SJCC makes a compelling case that DOE breached the agreement, i.e., failed to comply with applicable regulations, by withholding funds from SJCC for six months without affording it a hearing. It…
