Linde, was tried before a justice of the peace for violation of section 3 of the Motor Vehicle act of 1919 as amended and was found guilty and fined. He appealed to the circuit court of DuPage county, where he waived a jury. There was a trial by the court, resulting in a finding of guilty and the imposition of a fine.
