Affirming.
Appellant was indicted charged with the murder of I. N. Young by shooting him, and upon his trial was found guilty of manslaughter and his punishment fixed at confinement in the penitentiary for three years.
His motion for a new trial was overruled and he has appealed.
The only two grounds relied upon for reversal are, (1), that the court erred in its refusal to direct the jury to find the defendant not guilty at the close of the Commonwealth’s evidence and at the close of the whole evidence, and, (2), because the verdict is palpably and…
