Appeal by the relator, Henry D. Cochrane, as executor, etc., of Henry Peek De Graaf, deceased, from an order of the Supreme Court, made at the Hew York Special Term and entered in the ■office of the clerk of the county of Rew York on the 21st day of June, 1899, denying the relator’s motion for a peremptory writ of mandamus.

The relator moved for a writ of peremptory mandamus directing the respondents, the taxing authorities of the city of Rew York, *240to cancel or strike from their assessment rolls the record of an assessment for personalty against “ the executors, administrators or trustees. of the estate of Henry Peek He Graaf.” The assessment was made on the second Monday of January, 1898, and in May,. 1899, after the warrant for the collection of the tax was in the hands-of the marshal, this motion was made.
