The statement of the nature and result of the suit contained in appellant’s brief, and which is accepted as practically correct by appellee, is as follows:
“This suit was instituted in the District Court of Travis County on the 1st day of December, 1903, by the American National Bank of Austin, Texas, as plaintiff, against W. L. McGaughey, John D. Mc-Gaughey and Mrs. A. A. McGaughey, wife of W. L. McGaughey and George W. Littlefield as defendants, to recover from the defendants W. L. McGaughey and John D.
