MORRIS, District Judge.

This is an action brought to recover of the defendants assets alleged to belong to the bankrupt’s estate.

On the 19th day of August, 1933, Leroy C. Gilbert of Hillsboro, county of Hillsboro, state of New Hampshire, was adjudged a voluntary bankrupt. On May 15, 1934, the case was closed as a no-asset case. On July 10, 1934, the bankruptcy case was reopened upon the petition of Wesley M. Brush, a creditor of the bankrupt. On July 25, 1934, Carl M.
