This is an appeal from the order of the Court of Common Pleas of Allegheny County denying plaintiff-appellant’s motion for a new trial in an action of trespass which arose as a result of personal injuries received in an automobile accident which occurred on July 9, 1958, on Duncan Avenue in Hampton Township, Allegheny County. At the time of the accident appellant, a licensed driver, was seated in the front seat of an automobile owned and operated by Robert Quinn, 42 years of age, who was operating on a learner’s permit.
