This is an action in the Cook circuit court to recover damages for a personal injury sustained by Mary A. Hutchinson by reason of being thrown from a car of the North Chicago Street Railroad Company. The declaration consisted of four counts, but at the conclusion of the evidence plaintiff dismissed as to the second and third, and the cause was submitted to the jury upon only the first and fourth. The jury returned a verdict of guilty, assessing plaintiff’s damages at $5000, and from a judgment of affirmance in the Appellate Court for the First District the railroad company prosecutes this…
