This shit was instituted by appellant to recover damages in the sum of $10,000 alleged to have accrued through the negligent killing of Esteven Perez, her son. A trial by jury resulted in a verdict and judgment for appellee.

The allegations as to negligence were as follows: “Plaintiff alleges that heretofore, to wit, on or about the 3d day of November, 1900, deceased Esteven Perez was in the employ of defendant company as a section hand on defendant’s line of railway in Bee County, Texas, on. section known as section No. 70, under the direction and supervision of one…
