PLY, Associate Justice.

This is a suit for damages occasioned by the death of Andrew P. Crawleigh, which was instituted by appellant, the father of deceased, against appellee. After hearing the evidence the court submitted no issue, except the question as to whether deceased when killed was a passenger on appellee’s train. The issue was found against appellant and judgment was rendered for appellee.

There was a conflict in the evidence as to the circumstances under which deceased boarded the train of appellee a short time before his death, but the verdict of the jury on the issue as to deceased…
