This is an appeal from an order of his Honor, Judge Benet, presiding in the Court of Common Pleas for Bamberg County, allowing an appeal to said Court from the verdict of a jury empanelled to ascertain the compensation to which the South Bound Railroad Co. is entitled for the use of its lands by the Atlantic Coast Line Railroad Co., under the provisions of sec. 1744 of the Rev. *319Stat. of 1893. The order appealed from, which is set out in the “Case,” should be incorporated by the reporter in the report of this case.
