This is an appeal by the defendant from an order denying a motion made by him for a new trial on the minutes of the judge presiding at the trial, and from the judgment against him herein, entered upon the verdict of a jury.

This action is prosecuted for the recovery of $1,295, alleged to have been due from the defendant to the plaintiff at the time of the commencement of this action on January 19, 1887, under a contract of employment between the parties.

The complaint alleges that on September 25, 1886, the plaintiff and defendant entered into a contract in writing, in and by which the defendant employed the plaintiff to perform certain work and services for the defendant, for which the defendant agreed to pay the plaintiff thirty-five dollars a week from September 25,1886, until September 25,1887; that the…
