PICKETT, Circuit Judge.

The United States brought this action in the United States District Court for the District of Kansas to recover rent due from the defendant under a written interim lease and an alleged oral lease entered into by and between the parties. The defendant answered and admitted the rent due under the interim lease but denied that any oral lease was entered into between the parties.
