OPINION of the Court.

THIS was an action of detinue, brought in the circuit court by Henry and Boggs, to recover from Jones several negro slaves, which were mortgaged by the latter to the former. Jones pleaded the general issue, and also, that the cause of action in the plaintiff’s de? *47duration alleged, did not accrue within five years next preceding the original writ in this case, &c.
