Appeal from a judgment of the superior court for King county, Albertson, J., entered September 28, 1912, upon the verdict of a jury rendered in favor of the plaintiff for false imprisonment.

The purpose of this action was to recover damages for illegal arrest and unlawful imprisonment. The cause was tried to the court and a jury, and a verdict in the *694sum of $500 was returned. Judgment was entered upon the verdict. The defendant appeals.

The facts, briefly, are: For some time prior to the month of September, 1911, the respondent had been engaged in business in Valdez, Alaska. He disposed of his business there and embarked upon the steamship Alameda, which arrived in Seattle some time during the night of September 21st.
