Britton v. Co-Op Banking Group

Court of Appeals for the Ninth Circuit

1Opinion of the Court

FLETCHER, Circuit Judge:

This appeal is one component of a larger securities fraud litigation. Appellant, Jeff Liebling, appeals pro se the district court’s denial of his motion to compel arbitration in an action brought in federal court by appel-lees for damages caused to them by Lie-bling’s alleged fraudulent activities. We hold that the district court erred in finding that Liebling waived his right to arbitration. We remand, however, for consideration of whether Liebling is within a class of persons entitled to arbitration under the contract containing the arbitration clause.
