John Eugene Anderson (hereinafter “petitioner”) appeals the Circuit Court of Wood County’s March 12, 2012, order denying his motion for judgment of acquittal, or alternatively, motion for a new trial arising out of his conviction of first degree murder, for which he was sentenced to life in prison with mercy.
