The action is brought to recover for mental suffering claimed to have been caused to the *119plaintiff through the negligence of the defendant in failing to provide the necessary care to guard the body of the plaintiff’s brother, which had been buried in the cemetery of the defendant pursuant to an agreement between the plaintiff and the defendant whereby, in consideration of a money payment by the plaintiff, the body of his brother was buried in the said cemetery. The plaintiff further alleges that through the negligence of the defendant the body was stolen from the grave. The defendant moves…
