The petitioner below and appellant herein, Randy D. Abshire, appeals from an order of the Circuit Court of Berkeley County, entered on July 2, 1993, which affirmed the April 3, 1992, order of the respondent below and appellee herein, Jane L. Cline, Commissioner of the Department of Motor Vehicles (DMV). 1 The primary issue on appeal is whether the circuit court erred by affirming the DMV’s decision that Mr. Abshire was not entitled to have his administrative hearing continued.
