This, action, tried before the court, a jury being waived, was brought to. recover a balance alleged to be due to the plaintiff for commissions upon the sale of certain real property belonging to the defendant corporation, under *594the provisions of an agreement in writing between them, bearing date March 7, 1907.
By the terms of this agreement, plaintiff was constituted the sole selling agent of the'defendant in respect of a tract of land divided into a large number of lots, situate at Bellport, L. I., and it was stipulated that the plaintiff should receive, for commission and compensation,…
