This was an action to recover damages for the breach of a contract. Both parties have appealed, and they will be referred to in this opinion as plaintiffs and defendants.

This case was before this court on an appeal from an order of the district court sustaining defendants’ motion for a judgment on the pleadings. The judgment of the district court was reversed. (Stephenson v. Peterson, 131 Kan. 690, 293 Pac. 497.) The case was tried to the court without a jury on the pleadings, reviewed and sustained by this court on the former appeal. The…
