In an action, inter alia, to recover damages for breach of contract, the defendant appeals from so much of an order of the Supreme Court, Nassau County (Driscoll, J.), entered August 5, 2014, as granted the plaintiffs motion for summary judgment on the complaint and pursuant to CPLR 3211 (a) (1) to dismiss its counterclaims.
Ordered that the order is affirmed insofar as appealed from, with costs.
