— Appeal from a judgment of the Albany County Court, rendered January 3, 1978, convicting defendant upon his plea of guilty of the crime of burglary in the third degree and sentencing him to a term of imprisonment with a minimum of three years and a maximum of six years. As a result of being apprehended within a building at 879 Madison Avenue in the City of Albany on October 22, 1977, at about 1:55 a.m., the defendant was indicted for the crime of burglary in the third degree, a class D felony.
