In this case of alleged discrimination based upon the Americans with Disabilities Act of 1990 (“ADA”), 42 U.S.C. § 12101 et seq., defendant renews its motion for summary judgment dismissing the complaint which this Court denied in an opinion dated December 3, 1997, 1997 WL 749386 (S.D.N.Y.) (“Berk I”), familiarity with which is as sumed. Plaintiff cross-moves for partial summary judgment holding that she is disabled within the meaning of the ADA.
