— Appeal by defendant from a judgment of the Supreme Court, Queens County, rendered April 15, 1977, convicting him of assault in the second degree, upon a plea of guilty, and imposing sentence. Case remitted to the Family Court for further proceedings in accordance herewith. The appeal is held in abeyance in the interim. This case stems from the alleged stabbing of the complainant on June 12, 1974 by her husband, the defendant.
