An original and amended petition has been filed in this court under the above-mentioned style by Sam A. Conner, sheriff of Hamilton county, containing in substance the following allegations:
That on the 17th day of December, 1912, the defendant, C. J. Hebert, filed a petition for the writ of habeas corpus before Hon. A. B. Neil, judge of the criminal *224court of Davidson county; that in obedience to the prayer of this petition the said judge of the criminal court issued his fiat to the present petitioner, Sam A.
