delivered the opinion of the Commission of Appeals, Section A.

This suit was instituted by the defendant in error, Mrs. Billie Powell, against the plaintiff in error, Indianapolis Life Insurance Company, which will be called the “Insurance Company.” The suit is founded on a life insurance policy for the sum of $1500 issued by the Insurance Company to Victor H. Powell on May 11, 1931. Mrs. Powell is the widow of the insured, Victor H. Powell, and is the beneficiary named in said policy. The insured died on December 24, 1932.
