Error to a judgment of tbe law and Equity Court of tbe city of Richmond, in an action of trespass on tbe case. Judgment for the defendant on a demurrer to tbe evidence. Plaintiff assigns error. Tbe opinion states tbe case.

This action was instituted to recover damages for the death of Thomas C. Pendleton, who died from injuries received at the tmvn of Ashland, Virginia, while crossing the track of the defendant in error in order to take a train to the city of Richmond.

Upon the trial, there was 'a demurrer to the evidence, and the judgment of the Law and Equity Court upon that demurrer was for the defendant.
