This action is instituted for a separation from bed and'board; a recovery of the paraphernal property of the wife, a dissolution and settlement of the community of acquests and gains and partition of the same.

The petition states the parties were married in the State of New York in the month of April, 1834, the plaintiff being a resident of the State of Louisiana, and the defendant then a resident of the former State.
