In February 1992 Evelyn Boykin and Judith Meredith filed, on behalf of themselves and all those similarly situated, a class action suit against Smart Corporation (Smart), St. Vincent’s Hospital, and Simon-Williamson Clinic.

The complaint alleged the following, in pertinent part: Boykin and Meredith had been patients of the named medical facilities. The named medical facilities had breached their duties to maintain the confidentiality of their patients’ medical records and had invaded their patients’ privacy by contracting with Smart, a professional…
