The opinion of December 21, 2012, is withdrawn, and the following is substituted therefor.

*332In the proceedings below, Elizabeth W. Morris filed claims of false imprisonment and assault and battery against her former husband, Matthew D. Morris. After a trial, the Baldwin Circuit Court (“the trial court”) entered a judgment on the jury’s verdict, awarding Elizabeth $75,000 in compensatory damages and $125,000 in punitive damages, for a total damages award of $200,000.
